Terms of Use

Clinical Confidence is a professional practice workspace provided by QVARI Pty Ltd ("we", "us") to individual healthcare professionals for the purpose of recording continuing professional development (CPD), reflections, learning goals and supporting evidence. You may use the service for your own professional practice and career record.

You are responsible for maintaining the confidentiality of your account credentials, for all activity that occurs under your account, and for keeping your contact details current. Accounts are personal; you may not share access with another individual.

You remain the sole professional author of every record you save. The platform assists in organising, drafting and retrieving your professional information, but it does not certify the accuracy, adequacy or regulatory sufficiency of what you record.

Clinical Confidence does not provide clinical, legal, financial or regulatory advice. Nothing in the service is a substitute for the independent professional judgement of a qualified practitioner. You must not rely on any content, suggestion or automated output as a basis for clinical care decisions.

You agree not to: (a) upload content you are not entitled to store; (b) upload identifiable patient information or other sensitive third-party data that is not necessary for your professional record; (c) attempt to disrupt, reverse-engineer or probe the service; (d) use the service to harass, defame or infringe the rights of others; or (e) use the service in breach of any applicable law.

You retain ownership of the professional records, reflections, goals and evidence you create. You grant us a limited licence to store, process and display that content solely to operate the service for you. The Clinical Confidence platform, its interface, software, copy and branding are owned by QVARI Pty Ltd or its licensors.

The service is provided on a reasonable-efforts basis. It may be unavailable from time to time for maintenance, upgrades, or reasons beyond our control. During the Private Alpha, availability and functionality are not guaranteed.

We may suspend or terminate access where an account is used in breach of these Terms, in breach of applicable law, or where continued use presents a security, privacy or safety concern. You may close your account at any time by contacting us.

To the maximum extent permitted by law, our liability arising from or in connection with the service is limited to re-supplying the service or the fees paid by you for the service in the twelve months preceding the claim. Nothing in these Terms excludes rights you have under the Australian Consumer Law that cannot lawfully be excluded.

These Terms are governed by the laws of the State of Victoria, Australia. Each party submits to the non-exclusive jurisdiction of the courts of that State.
